The Prudent Investor Rule creates a potential ethical dilemma for investment advisors selling over-the-counter financial products issued by their firms. The "opportunity" to defraud investors using complex, over-the-counter derivative securities designed for client-specific risk management is much higher than for exchange traded securities. This paper emphasizes the ethical responsibility held by trustees and their organizations to eliminate potential conflict of interests through internal control and monitoring. Independent evaluations of the performance of investment advisors and independent appraisals of complex over-the-counter securities (...) are important in reducing the risks of conflicts of interest. Recent lessons learned from the corporate ethics crisis and requirements of the 2002 Sarbanes Oxley Act would suggest that conflict of interest must be eliminated with third party validation of derivative pricing. This paper draws upon the meta-ethical insights of Bernard Lonergan and Raimond Gaita to bolster the foundational claims of Linda Zagzebski’s exemplarist moral theory. I aim to refine Zagzebski’s approach by pointing out how a community’s inevitable prioritization of a given paradigm of moral exemplarity plays a decisive role in the trajectory of its ethical reasoning. I conclude by arguing that within the Christian community, encounters with sanctity should determine the identification of virtues rather than vice versa.

ISBN: 978-0-19-887007-4.Pierre Bayard's masterful How to Talk about Books You Haven't Read offers soothing balm for readers in the daunting presence of Augustine's City of God. Weighing in at a third of a million words, (...) Augustine's magnum opus et arduum,1 offers a Moby-Dick and a half of verbiage spread out over twenty-two books. I make the claim, nervously and looking about for intelligent contradiction, that it is the longest work of sustained and coherent argument to survive from Greco-Roman antiquity. Other behemoths are compilations in the main of one kind or another, but this one has a structure and a linear direction and was tightly enough written that a theme opened in the second book with a promise of returning with later treatment is in fact picked up in the nineteenth book written perhaps a dozen years later.Those who really will read, or at least read in, Civ. benefit from all the help they can get. There are good translations (English alone in my lifetime by McCracken et al. in Loeb, Bettenson, Dyson, and Babcock) but none provides more than a minimalist annotation. Francophone readers have been better served since 1960 by the five volume edition with more ample annotation in the Bibliothèque Augustinienne of G. Bardy et al., and it is the standard point of entrance to serious study for scholars. That work has many strengths but the limitations of arising from a devout tradition of scholarship and of coming before the efflorescence in late antique and Augustinian studies through which we have lived.More help is now at hand in the form of the volume under review and its promise of more to come. Gillian Clark is known and admired among Augustinian scholars for many works, not least the earlier exercise in commentary of her Cambridge "green and yellow"2 edition of Confessions 1–4 (1995). The present work began as an ambitious multi-author collaborative project that proved unwieldy (see the present volume, pp. 31–32) and results in this first installment of [End Page 179] a series now in Clark's hands exclusively, drawing on her strengths as a classical historian specializing in late antiquity and patristics. Four additional volumes are anticipated, ideally on two-year intervals. The task requires multiple competences: at least, the history of the fourth and fifth centuries, the history and presence of ancient philosophy, the history of Christian reception and interpretation of scripture, and the reception of classical literature in late antiquity. It is a work that soars with no middle flight.As commentary on a behemoth, the commentary begins with the virtue of concision. At a rough calculation, commentary here runs at about half again the length of the text under review, producing volumes that can be usefully read alongside Augustine without swamping either Augustine or the reader in an ocean of erudition and detail. After an introduction that is as much to the whole work as to books 1–5, the book is organized strictly by lemmata to passages commented. The lemmata are all in Latin to facilitate use by readers of various editions and translations, with references given by book/chapter and page/line to the standard CCSL 1955 reprinting of the edition of Dombart-Kalb (itself originally a Teubner of 1928).3The focus of the annotation is on the work as historical artifact, well situated in both the moment and controversies of writing and in the apparatus of learning that Augustine brought to his work. Inevitably this includes welcome discussion of argument, rhetoric, and strategy (the very short discussion of how Augustine wrote on pp. 9–12 is remarkably insightful), but readers will welcome the lucid guidance offered to how the text made sense in Aug.'s own time, to what he was evidently reading as he wrote, and to the range of historical realia that make up his argument. Following Linda Zagzebski's discussion of the paradoxical implications of moral luck for Christian morality, I explore the role of religious luck in two accounts of divine election – that of Paul the Apostle and that of the sixteenth-century Jewish thinker, Rabbi Judah Loeb of Prague. On both accounts, special religious status is conferred unrelated to the deserts of the beneficiary. What sense does it make to ascribe religious worth to someone if it simply came his way? Both accounts (...) appeal to the notion of religious virtue to answer this question. On Rabbi Judah's account, like ethical virtues, religious virtues inhere within the essence of their bearer and thus belong to him necessarily; on Paul's they are accidental, a matter of luck. In the Transcendental Aesthetic (TA), Kant is typically held to make negative assertations about “things in themselves,” namely that they are not spatial or temporal. These negative assertions stand behind the “neglected alternative” problem for Kant’s transcendental idealism. According to this problem, Kant may be entitled to assert that spatio-temporality is a subjective element of our cognition, but he cannot rule out that it may also be a feature of the objective world. In this paper, I show in a new (...) way how Kant’s view (focusing on his conclusions about space) is not subject to this objection, by showing that he does not make the denial about mind-independent reality that he is typically held to make. The argument develops consequences of a new reading of Kant’s expression “an sich selbst” (‘in itself’; ‘in themselves’). I argue that “an sich selbst” or “per se” has a special, judgment-level role, so that this expression does not form new noun-terms adjectivally. It follows that the conceptual unit of Kant’s “Conclusions” in the TA is simply “things” (Dinge), since “things in themselves” is not a nominal expression; Kant adopts the Wolffian ontological use of “thing” as the basic kind-term for any existent. The arguments that things per se are not in space are arguments that space cannot be a necessary property or relations of things as a kind. I show that this does not involve the positive claim about mind-independent reality that inspires the neglected alternative objection. (shrink)

The Ethics of Need: Agency, Dignity, and Obligation argues for the philosophical importance of the notion of need and for an ethical framework through which we can determine which needs have moral significance. Pointing out problems with evaluative models of the emotional mode, a paradigmatic shift captured by the Amenable Argumentation Approach is explained as a way forward for the advancement of the emotional mode and multi-modal argumentation.

Enquiries into the possible nature and scope of innate knowledge never proceed in an empirical vaccuum. Instead, such conjectures are informed by a theory concerning probable representational form. Classical approaches to the nativism debate often assume a quasi-linguistic form of knowledge representation and deliniate a space of options accordingly. Recent connectionist theorizing posits a different kind of represenational form, and thus determines a different picture of the space of possible nativisms.

This paper argues that an emotion is a state of affectively perceiving its intentional object as falling under a “thick affective concept” A, a concept that combines cognitive and affective aspects in a way that cannot be pulled apart. For example, in a state of pity an object is seen as pitiful, where to see something as pitiful is to be in a state that is both cognitive and affective. One way of expressing an emotion is to assert that the (...) intentional object of the emotion falls under the thick affective concept distinctive of the emotion. I argue that the most basic kind of moral judgment is in this category. It has the form “That is A” (pitiful, contemptible, rude, etc.). Such judgments combine the features of cognitivism and motivational judgment internalism, an advantage that explains why we find moral weakness problematic in spite of its ubiquity. I then outline a process I call “thinning” the judgment, which explains how moral strength, weakness, and apathy arise. I argue that this process is necessary for moral reasoning and communication, in spite of its disadvantage in disengaging the agent's motivating emotion from the judgment. (shrink)

This paper elaborates on the idea of the epistemology of ignorance developed in Charles Mills’s work beginning in the 1980s and continuing throughout his writings. I I argue that his account developed initially from experiences of racism in north America as well as certain methods of organizing within parts of the Caribbean left. Essentially the epistemic practice of ignorance causes knowers to discredit or push away knowledge they in fact have. But this gives us cause for hope, for restoring existing (...) knowledge through changing ideas about who knows. (shrink)

Senior managers are important to the successful management of ethics in organizations. Therefore, their perceptions of organizational ethics are important. In this study, we propose that senior managers are likely to have a more positive perception of organizational ethics than lower level employees do largely because of their managerial role and their corresponding identification with the organization and need to protect the organization’s image as well as their own identity. By contrast, lower level employees are more likely to be cynical (...) about the organization’s ethics. In order to compare senior managers’ and lower level employees’ perceptions of ethics in the organization, we surveyed randomly selected senior managers and lower level employees in three firms. We found that perceptions of ethics in the organization differed predictably across levels, with senior managers’ perceptions being significantly more positive and lower level employees’ perceptions being more negative. On the question of the conclusion of a piece of practical reasoning, few have been willing to follow Aristotle's lead. He said the conclusion was an action. These days, the conclusion is usually described either as a proposition about what one ought to do, or as a psychological state or event, such as a decision to do something, an intention to do something, or a belief about what one ought to do. Why favor these options over the action-as-conclusion view? By (...) far the most oft-repeated answer is that these views, unlike Aristotle's, can accommodate the case in which a conclusion is drawn but not acted upon. The conclusion cannot be an action, it is said, because it is possible to reach a conclusion about what to do without doing the action. My thesis is that this objection fails, and that as a consequence no radical departure from Aristotle's proposal is warranted. (shrink)

By now one might hope that the robust body of theoretical work recently published on immigration ethics would have taken general political philosophy a long way from the prevailing Rawlsian-style insularity premise, according to which society is “a closed system isolated from other societies” into which persons “enter only by birth and exit only by death.” But there are still a great many political theorists whose focus is unreflectively endogenous and who assume away questions of states’ constitutive scope and boundaries. (...) One of the signal merits of David Miller's new book,Strangers in Our Midst, is that it lucidly demonstrates why ignoring state boundary constitution is untenable for political theory.
